- AGAINST NON-IMPLEMENTATION OF THE ASSURANCE GIVEN BY GROUP OF MINISTERS TO NJCA
- DEMANDING IMMEDIATE SETTLEMENT OF THE CHARTER OF DEMANDS

Dear Comrades,
The National Secretariat of the Confederation of Central Government
Employees & Workers met on 30.09.2016 at New Delhi, reviewed the
progress made in settlement of the charter of demands submitted by the
JCM (NC) staff side to the Central Government, with particular reference
to the assurance given by the Group of Ministers regarding constitution
of a High Level Committee for increasing the minimum wage and fitment
formula. The National Secretariat viewed with grave concern the totally
negative and indifferent attitude of the NDA Government towards the
genuine demands of the Central Government employees and expressed its
strong protest against non-implementation of the assurance given by the
Cabinet Ministers to the NJCA till this date. As already resolved by the
25th National Conference of the Confederation held at Chennai from 16th
to 18th August 2016, the National Secretariat decided to organize
independent campaign and agitational programmes culminating in strike
action. The National Secretariat, at the same time, resolved to maintain
unity under the banner of NJCA intact and also resolved that
confederation while conducting its own independent campaign and
agitational programmes, shall fully implement all the programmes of NJCA
also at all levels.
Accordingly, the National Secretariat decided to organize the above
mentioned phased programme of action during the months of October,
November and December 2016. The National Secretariat further deiced that
before finalizing the date of the strike action, the Confederation
leadership shall contact all likeminded organisations and effort should
be made to bring maximum unity of Central Government employees for the
proposed strike action.
For the December 15th Parliament March, National Secretariat fixed the
following quota for ensuring participation of about not less than 20000
employees in the March.
1. National Federation of Postal Employees (all affiliates): 100002. Income Tax Employees Federation: 25003. Audit & Accounts Association: 10004. Civil Accounts Employees Association: 8005. National Federation of Atomic Energy Employees: 3006. Ground Water Board Employees Association: 3007. Other Affiliates (Each): 1008. COC West Bengal: 10009. COC Tamilnadu: 100010. COC Kerala: 50011. COC Uttar Pradesh: 100012. COC Mumbai: 50013. COC Nagpur: 30014. COC Andhra/Telangana: 100015. COC Karnataka: 50016. All other COCs (Each): 30017. COC Delhi: 3000
Major
organisations shall arrange Accommodation for the participants from
their organization. Regarding small organisations and COCs they should
contact in advance the Confederation CHQ, in case accommodation is to be
arranged.
Affiliated organisations and COCs should fix state-wise quota and
affiliated organization-wise quota immediately and inform all
affiliates/State units immediately to enable them to decide the
participants
Travel tickets for the participants in the Parliament March should be
booked immediately, as otherwise it will be difficult to get
reservation.
Other details will be given in the next circular. Charter of demands approved by the National Secretariat is enclosed herewith.
MAKE THE PROGRAMMES GRAND SUCCESS
All affiliated organisations and COCs are requested to start
preperations immediately for making the above mentioned three-phases of
programmes a grand success.

Misconduct against women staff must be dealt with sternly, draw up a list of "dos and dont's" for male employees: HC
Mumbai, Oct 4 - Any misconduct against women employees must be dealt
with most sternly, the Bombay High Court today said and asked
organisations to draw up a list of "dos and dont's" for male employees
over conduct towards female staff.
A division bench headed by Justice V M Kanade referred to a judgement of
the US Supreme Court and cited that "sexual misconduct cannot be viewed
in a vacuum" and that employers and organisations must identify the
"underlying threat of violence" in such conduct against women.
The observations were made by the high court while hearing a petition
filed by a central government employee seeking action against her
superior over allegations of sexual harassment.
The bench today noted that organisations must treat all complaints of
sexual harassment seriously and without bias and that it was also
necessary to provide safeguards and assistance to female employees.
"In the past, such behaviour would be ignored and terms as part of the
work culture. It was even said that men had said or done things
inadvertently. But now all organisations must change with the changing
times. Any misconduct against women employees must be dealt with most
sternly," the court said.
The woman approached the high court after the internal committee at her
workplace ruled that while the incidents she had reported against her
superior did show that she had been inconvenienced and harassed, the
same did not amount to sexual harassment.
The internal committee had penalised and demoted the superior. However, the woman sought harsher punishment for her superior.
The court today denied to increase the punishment and said it need not interfere with the committee's decision.
According to the woman, between 2011 and 2013, her superior made several
sexual advances at her and when she began to openly spurn his advances,
he resorted to threatening her professional growth and career,
insulting and humiliating her in front of other employees, and isolating
her by asking others not to talk to her.
